These Terms and Conditions (“Terms”) govern your access to and use of the website of Windborne Wolf Publishing (referred to as “we,” “us,” or “our”), located at www.windbornewolf.com, and any services we provide. By accessing our website or contacting us through our lead form, you agree to these Terms. If you do not agree, please do not use our website or request services.

1. Our Services

Windborne Wolf Publishing provides the following services:

  • Book publishing and self-publishing assistance
  • Book editing
  • Book layout and formatting
  • Web design and development (including improvements for AI agents and accessibility)
  • Graphic design
  • Marketing services

All services are provided under a separate written proposal or agreement. The information on our website is for general information only and does not constitute a binding offer to provide services.

2. Contact and Lead Form

You may contact us through our website lead form. Any information you submit is handled according to our Privacy Policy. Submitting a form does not create a contractual relationship until we both agree in writing (via signed proposal or email confirmation).

3. Client Responsibilities

When working with us, you agree to:

  • Provide accurate, complete, and timely content, images, feedback, and other materials.
  • Ensure you have all necessary rights, licenses, or permissions for any materials you supply us.
  • Respond promptly to communications and approvals.
  • Maintain a stock image subscription (or equivalent rights) for images used in your project.

4. Payment Terms

  • A 50% deposit is required before work begins.
  • The remaining 50% is due before final delivery of the completed project.
  • Any additions or changes to the original project scope must be agreed upon in writing and will be paid in full at the time we accept the new scope.
  • All prices are in USD and exclude applicable taxes.
  • We accept the payment methods specified in your proposal.
  • No refunds will be issued after work has begun on your project.

5. Revisions

We typically include two (2) rounds of revisions in our standard proposals. Additional revisions are negotiable and may incur extra fees. You must review and approve work at each milestone. Delays in providing feedback may result in project timeline adjustments.

6. Intellectual Property

  • Our Work: Upon full and final payment, we grant you a perpetual, non-exclusive license to use the final deliverables for their intended purpose. We retain ownership of all underlying designs, code, tools, templates, and methodologies unless otherwise agreed in writing.
  • Your Content: You retain ownership of the materials you provide. You grant us a limited, royalty-free license to use them solely to complete your project.
  • We reserve the right to showcase completed projects in our portfolio and marketing materials unless you specifically request confidentiality in writing.

7. Hosting and Third-Party Services

We can work with Wix, WordPress, Hosting.com, or most other platforms. We recommend Hosting.com for hosting. You are responsible for purchasing and maintaining any third-party services (hosting, domains, stock image subscriptions, etc.). We are not responsible for third-party service issues, outages, or pricing changes.

8. Warranties and Disclaimers

We strive to deliver professional, high-quality work. However, we do not guarantee specific business outcomes such as book sales, website traffic, search rankings, or marketing results. Services are provided “as is” to the extent permitted by law.

9. Limitation of Liability

To the fullest extent permitted by law, Windborne Wolf Publishing shall not be liable for any indirect, incidental, consequential, or punitive damages. Our total liability shall not exceed the total amount paid by you for the specific project.

10. Termination

Either party may terminate a project for material breach. Upon termination, you are responsible for payment for all work completed up to the date of termination. No refunds will be provided for work already performed.

11. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information disclosed during the project.

12. Governing Law

These Terms and any agreements between us are governed by the laws of the State of Arkansas, United States. Any disputes shall be resolved exclusively in the courts located in Washington County, Arkansas.

13. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Your continued use of our website after changes constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
